| 内容記述 | 本稿は, 中国の居民委員会の性格や活動内容を規定する「都市居民委員会組織法」や中国憲法を検討し, また上海市のある居民委員会を事例として, 実際の活動例を検討する。その目的は, 町内会・自治会研究に比較対象として居民委員会を導入する際に必要であると思われる予備的作業を試行することである。そこから見出される主な事柄は以下である。まず, 活動内容は, 対内的には「生活充足活動」, 「共同防衛活動」, 「住民統合活動」, 対外的には「対地域活動」, 「対行政活動」に大別され, 多機能であること。また, 上記法等によって, 自治組織であると同時に行政協力組織であると規定された性格が与えられ, そして, 自治組織としては, 法律上からだけでなく, 実際の活動内容からも, 通常の地方自治機構とは別種の「もう一つの自治体」として考えられること。住民を選挙権者ならびに被選挙権者とする選挙から選出されたスタッフを有し, 住民による決定事項を執行する組織であること。構成単位については, 基本的には住民個人であるとされるが, 戸を単位とする場合もあり曖昧であること。なお, 文化的背景や歴史的遡及の問題に関しては, 直接には触れることはできなかった。 | |||||||

| 内容記述 | This paper is a attempt of preparatory consideration for comparison of the two locality groups, ""Chonaikai"" or ""Jichikai"" with ""Jumin"" weiyuan hui"". In this preparatory consideration, some laws and regulations are examined, that provide the activities and characters of ""Jumin weiyuan hui"" and an instance of ""Jumin weiyuan hui"" activities in Shanghai is investigated. The results of the above are as follows. 1) Activities of ""Jumin weiyuan hui"" have the inclusiveness and the diversity, in the same way as ""Chonaikai"" or ""Jichikai"". 2) In the laws and regulations ""Jumin weiyuan hui"" is provided as an organization for self-government, the other side, as the organization of cooperation with local administration system. Namely, it is clarified that ""Jumin weiyuan hui"" has double institutionalized characters. 3) From the consideration on the activities, rt could be said that ""Jumin weiyuan hui"" is characterized as the self-government organization that has the autonomy and the independence with limitation. | |||||||
