| 内容記述 | Habermasにおける法の概念は80年代と90年代では様相を異にする。以前は両義的な役割を担っていた法は、今や、コミュニケーション権力を行政権力に転換するためのメディアという、より積極的な役割を果たすようになった。しかしこの理論的変化の意味は十分明らかにされておらず、本論はその解明を目指すものである。この変化の中心的な理由は、『事実性と妥当性』において望ましい社会の像が刷新されていることにある。それは、正統性と安定性という二つの要請を同時に充たす社会秩序の構想である。 | |||||||

| 内容記述 | The concept of law in Habermas has changed between 80s and 90s. Whereas the law, formerly, played an ambivalent role in his social theory, it takes now more positive one as a medium for transforming communicative power into administrative power. The meaning of this theoretical change is, however, not fully elucidated. This paper attempts to make it clear : The central reason of the change consists in the fact that he acquires a renewed vision of desirable social institution in Faktizitat und Geltung. It enables a social order to be legitimate and stable at the same time. | |||||||
